Consent - All Sense-Ability Clients
By ticking the Terms & Conditions box on the Sense-Ability Booking form, or stating that you agree to Sense-Ability’s Terms & Conditions by email, you are agreeing to the following:
You understand:
The nature of the therapy that Sense-Ability offers and the requirement to give informed consent to receive therapies as discussed during the Initial Consultation, including, if relevant, hypnotherapy.
Your therapist is Jane Pendry, a qualified and accredited Solution Focused and Clinical Hypnotherapist. See qualifications below.
Jane Pendry is the sole Data Controller for Sense-Ability Hypnotherapy and Coaching. She is responsible for maintaining client records securely, and for determining all Policies detailed in the T&Cs.
Sense-Ability Policies reflect current GDPR regulations, ICO guidance, further guidance on ethics and privacy from all accrediting bodies of which Jane is a member, safeguarding regulations, and the requirements of Jane Pendry’s Insurer, Holistic Insurance.
Sense-Ability’s T&Cs aim to balance completing interests regarding client privacy and data protection, with legal protection for Sense-Ability and safeguarding of clients.
Whatever we discuss and agree in session is not binding upon you, nor is it a prescription.
You can refuse therapy, coaching or any suggested intervention within session at any time.
If undertaking hypnotherapy, you agree to listen to any recordings sent as part of your therapy but never when driving or doing anything that requires your full concentration.
The aim of Sense-Ability Solution Focused approaches is to have as many sessions that are needed to help the client achieve the outcome they want, and not one more.
Clients are free to leave therapy at any time, and no pressure is applied to continue with further sessions.
Where compassionate listening is required, Jane will hold the space, and gently direct clients towards finding their own solutions aligned with their own values, beliefs and motivations when the client is ready, without judgement.
If it becomes clear that the Sense-Ability approach is not right for the client, Jane will undertake a solution focused conversation to help the client find the right therapy or to take the next steps forward that are right for them.
All testimonials are provided by clients via Google Business, Yell or via text or email. I am required to keep a record of consent for the use testimonials and reviews sent to me directly to ensure they are genuine and correctly attributed as the client wishes, and as proof I have permission to use them.
Consenting to Cookies
You understand:
Cookies are small files picked up from websites that you visit. They are sent to your device (computer, tablet, phone, etc.) and can allow your device to remember which websites you have visited or what type of activity you engaged in.
Ticking the cookie pop up when you first access the Sense-Ability website means you agree to accept essential cookies required to carry out or facilitate the transmission of communications over a network. Essential cookies are automatically placed on your computer or device when you access a website as they are exempt from the requirement of consent as per the GDPR (General Data Protection Regulation) and ePrivacy Directive.
When ticking the cookie consent pop up, you also agree to accept basic ‘analytical’ cookies used to inform Sense-Ability of general trends in aggregate form. Trends include numbers of visitors, total number of unique visitors, total number of pages visited, areas that people have visited from (towns, cities, US states, countries) - by day, week, month and year. Sense-Ability cannot determine an individual’s behaviour nor track back data to a named individual.
Third-party cookies allows websites you are visiting to sell data. Please note Sense-Ability has no third-party cookies except those needed by Square (payment processing) and Google Analyics to analyse aggregated data. Google Analytics uses a set of cookies to collect information and report site usage statistics without personally identifying individual visitors to Google.
Personal Data gathered through the Sense-Ability online booking system includes personal contact details and optional information relevant for therapy.
The data gathered through the online booking system is processed on Sense-Ability’s behalf by Squarespace and Square, both of whom use conventional trusted cookies designed for this purpose.
When booking online you consent to your data being securely processed by Squarespace (website provider) and Square (payment processor). Processing means collecting and storing essential contact details, consent to terms and conditions, basic details about services you are enquiring about, and other optional information for use by Sense-Ability as outlined elsewhere in these T&Cs. In other words data you have chosen to share.
Squarespace (website provider) and Square (payment processing service) are reputable providers whose data protection and Cookie policies comply with GDPR and the ICO. They each have comprehensive data protection policies which can be found on their websites (see below).
If you feel in anyway uncomfortable about your data being processed and stored on the secure Sense-Ability site (set to highest level of security), please book and pay directly with Jane Pendry (payments can be made directly via PayPal, IZettle link, or bank transfer).

Consent - Overseas Clients
By notifying me that you have read and agreed to all these Terms & Conditions by email, you are also acknowledging that you understand that for all intents and purposes you are undertaking therapy with Jane Pendry in Oxford, England; and you understand that Jane Pendry is trained, accredited and insured in the UK.

You are aware of Sense-Ability’s Data Protection & Privacy Policies, and understand the relationship between Jane Pendry at Sense-Ability, and yourself or your child, under law.
The Data Protection Policy details the kinds of client records that may be created and retained, and the Cookie Policy. In addition the following Data Protection policy points are included.
You understand that:
All information clients choose to give Sense-Ability is confidential, and stored safely in line with the latest Data Protection Regulation, including GDPR.
The data controller, Jane Pendry, will keep paper records that relate to you in a locked cupboard. All online contact details and permissions are kept on an encrypted file, in an encrypted folder, as required by UK law and GDPR.
All paper records will be kept securely for up to 7 years and will then be shredded within that seventh year. Various laws and regulations have led to the decision to keep them for up to 7 years, including the requirements and guidance of Jane Pendry’s liability insurer (Holistic Insurance), and the guidance of different accrediting bodies who have interpreted the ICO guidance for therapists, taking into consideration competing interests (eg client’s privacy, legal protection of the therapist, insurance requirements, and safeguarding). The minimum requirement for retaining paper records of client sessions, determined by Holistic Insurance, is 5 years.
Jane Pendry will use your contact details for all reasonable communications related to your therapy, and to update you on any changes in services, prices or conditions for a limited period. Updates related to price changes, changes in policies or services may be sent to current and recent customers who have indicated they may return to therapy within the year.
A link to Sense-Ability news updates on the Sense-Ability website may be included in the signature strip of general email communications.
You will not be sent any dedicated Sense-Ability marketing communications such as enewsletters or email campaigns unless specific permission has been secured.
You will never be sent any unsolicited communications of any kind by mail.
Neither contact details nor personal information are shared, nor passed on to third parties for marketing purposes, except where there is a serious safeguarding issue (you or your close family member are in imminent danger of death, injury or abuse, as outlined under the Safeguarding Policy).
The right to be forgotten
The ICO which interprets GDPR and laws around data protection, states that you have the right to be forgotten on request.
Paper records can be minimised and anonymised on request. See note below. ICO guidance on retention policies can be found here.
Clients may ask for a copy of any notes or records related to them, and held by Sense-Ability. These must sent within a month of being requested.
You have the right to be forgotten for marketing purposes, even if you previously gave consent to marketing communications. This means you have the right to ask for your contact details to be removed from the Sense-Ability database once therapy has finished.
Clients have the right to ask for some notes to be redacted with some restrictions. Sense-Ability reserves the right to retain data required for legal protection or safeguarding purposes including the client’s name, the code number for that client, the date they began therapy, and the record of consent given prior to therapy starting, and essential notes on therapies delivered, or anything that might relate to legal and safeguarding issues, for up to 7 years as outlined above.
Clients may also request specific personal information disclosed in sessions is not to be recorded eg “I don’t want you to include my next disclosure on the written notes.”
Payment Terms
Individual Sessions
Payment must be made on the day of the session or before. If payment is not received before the session, your session may be cancelled.
Group Bookings
Group bookings, and multiple session bookings, must be paid through the Sense-Ability Booking Site (once live).
All sessions (dates and times) for courses are booked in at the time of booking.
Group sessions that form part of courses are booked and paid for in advance. These sessions will be on a fixed day at a fixed time which will be made clear at the time of booking.
Missed sessions that are part of a course cannot be refunded.
Individual sessions that form part of a booking of a series of individual sessions can be cancelled or moved by the client with 24 hours notice.
Safeguarding Policy
The British Criminal Disclosure Service has checked that Jane Pendry has no criminal convictions, as required by law, and Jane has an active DBS Certificate. This is a U.K. legal requirement for anyone working with children and vulnerable adults. It is also a requirement of British accrediting bodies to be DBS checked, and Jane’s DBS status has been verified.
Privacy and Confidentiality
All conversations with clients are private and confidential. However, if there is a direct danger to your life, or the life of someone else connected to you, you understand that Jane Pendry is obliged, under law, to notify the relevant authorities, your emergency contact, and any named medical professionals given to her during the initial consultation.
This also applies to clients who are children where there is clear evidence of neglect, abuse or a risk of suicide.
Domestic Abuse or Violence
Safeguarding includes family members and partners. Where there is clear evidence of verbal abuse, physical violence, ongoing coercive control or persistent degrading behaviour, Jane may break the privacy and confidentiality policy and contact relevant authorities, or medical professionals.
Children aged 12 and over
You must:
Provide consent for your underage child to undertake Sense-Ability therapies following the initial consultation
Secure verbal consent from your child. You must not coerce children to give consent. This therapy will not work if your child is not comfortable with the process.
Allow children to stop sessions or withdraw consent at any time.
Ensure that a responsible adult is in the house at all times during therapy.
Provide an emergency contact (yourself or alternatives as required) for your child
Be available to contact throughout the duration of any session. This is used mainly because children can fall asleep at the end of sessions or because you are required upon to give input.
You understand that:
Parents of children seeking therapy are required to attend the Initial Consultation in order to give fully informed consent.
All written communications are conducted through parents or carers.
Conversations with children remain confidential unless there is concern for the child’s welfare. However, homework and updates on progress, key outcomes and next steps, may be sent to the parent, and all sessions are organised via parents.
Under no circumstances will Jane have direct contact details for any child.
Contra-indications
Hypnosis may be contra-indicated if you have been under psychiatric care, or have a diagnosed mental health condition, that includes psychosis. In these instances, it is necessary to write to your psychiatrist or medical practitioner to seek professional advice before undertaking hypnosis.
You are under no obligation to disclose private medical details to Jane Pendry and your psychiatrist will not disclose private medical details without your express permission. Jane simply writes to ask whether hypnosis is safe for you or asks you to check directly with your medical practitioner.
It is your responsibility to let Jane at Sense-Ability know if she needs to contact your doctor. In this instance, please provide the relevant contact details of any medical professional.
If hypnosis is contra-indicated, Jane can create a tailored therapeutic pathway to meet your needs.
Diversity & Equality Policy
Jane aims to create a safe space for people of all beliefs and faith systems, and none, for neurodiverse people, the LGBT+ community and people of all nationalities without judgement.
Neuro-diverse Clients
Neuro-diverse clients can discuss and agree possible helpful adaptations eg a non-verbal autistic child may have their mother present in all sessions.
The nature of Solution Focused approaches are that clients develop personal agency (control over their own lives) and discover their own solutions so the process can be particularly helpful for neurodiverse clients.
Jane has experience, as a teacher and a therapist, of working with neurodiverse clients but has no professional specialist training in autism, ADD or ADHD and is not trained to assess or diagnose clients.
Trauma Aware
Jane is trauma aware and takes great care to tailor her services to keep clients safe at all time. Adaptations may include, seeing scripts before delivery, discussing possible triggers before hypnosis, creating tailored language patterns in sessions, using open suggestions instead of commands, and exploring whether relaxation, hypnosis and even silence may in themselves feel threatening. Jane works collaboratively with clients to ensure their safety at all times.

Cancellations Policy
You understand that:
You may cancel or re-arrange your appointment at any time up to 24 hours before your appointment.
You understand that same day cancellations may be charged at £25.
Sense-Ability Pathways & Therapies

Sense-Ability Pathways are therapeutic journeys that utilise the same core understanding of neuroscience and the nervous system, and all use similar Solution Focused and somatic approaches.
The Sense-Ability Pathway approach is rooted in Solution Focused Hypnotherapy and draws on other disciplines for more complex issues including mindfulness, breathing exercises, EFT and TFT tapping, Solution Focused Brief Therapy and Parts Hypnotherapy, as well as Dr Muss’ Rewind Trauma Technique.
Sessions are tailored to clients’ needs drawing from multiple disciplines and using different modalities.
Jane Pendry’s Training and Qualifications
Jane has a Diploma in Solution Focused Hypnotherapy, and a further Hypnotherapy Practitioner’s Diploma from the accredited trainers for Solution Focused Hypnotherapy, Clifton Practice Hypnotherapy Training. Jane has undertaken additional professional training from reputable sources eg The Clinical Hypnotherapy School and directly with Dr Muss for the Rewind Trauma Technique. Jane is committed to Continuous Professional Development and undertakes regular supervision with the AfSFH.

Complementary Support
Jane Pendry is a complementary therapist who specialises in Solution Focused Hypnotherapy, also known as a Clinical Hypnotherapist or a Solution Focused Hypnotherapist, who is also a psychotherapist in the broad sense.
Jane is not a Clinical Psychotherapist nor is she a medically trained professional.
Jane does not diagnose, analyse, nor claim to cure.
Where a diagnosis is required, for example for a medical condition such as IBS you are required to see a medical professional in the first instance before beginning therapy.
You, the client can effect profound change by steadily changing their own thoughts, feelings, actions and interactions which may positively impact on your health and wellbeing.
All and any changes to your mental and physical health, wellbeing, relationships, pain management, IBS symptoms or trauma triggers is down to the power of your own mind, and the capacity of your body and nervous system to heal.
